CITY OF BENTON
APRIL 20, 2009
The governing body of the City of Benton, Kansas met in regular session at the usual meeting place in the City at 7:02 p.m. Mayor Ken Gile was absent. Vice Mayor Dan Carpenter presided. Other members of the governing body were present as follows: Kathy Gomez, Jim Thompson and Gene Harrison.
PUBLIC COMMENT
Ryan Riggle was present to update the council on his progress with his property located at 230 S. Wichita. He will give another update at the June 15 meeting.
APPROVE MINUTES
Kathy moved to approve the minutes from the March 16 meeting as presented. Jim seconded. Motion carried 2-0. Dan abstained, he was absent at that meeting.
COUNCIL POSITIONS
Dan presented a plaque to Gene Harrison for appreciation of his service on the city council from 2001 - 2009. Gene did not run in this year’s election.
James Thompson was sworn in by city clerk.
STEARMAN ESTATES
Jeff Bridges, city financial advisor, presented the necessary documents for the temporary notes for Phase II of Stearman Estates.
Resolution 04-09, A Resolution Providing for the Issuance of Temporary Improvement Notes of the City of Benton, Kansas in the Total Principal Amount of $150,000.
Kathy moved to approve Resolution 04-09. Jim seconded. Motion carried 3-0.
Resolution 05-09, A Resolution of the City of Benton, Kansas Authorizing and Providing for the Underwriting and Offering for Sale of the City’s Temporary Improvement Notes Series A, 2009 in the Approximate Principal Amount of $150,000.
Kathy moved to approve Resolution 05-09. Jim seconded. Motion carried 3-0.
Underwriting Agreement between the City of Benton, Kansas and DeWaay Financial Network.
Jim moved to accept the Underwriting Agreement. Kathy seconded. Motion carried 3-0.
PRAIRIE VILLAGE
Jeff presented information on the unpaid specials in Prairie Village on lots owned by developer Tim Malone. Mr. McAllister is also a part owner of Prairie Village and is considering taking over the development. It is the consensus of the council to draw on the Letters of Credit for the unpaid specials.
Kathy moved to allow Jeff to proceed with paperwork to draw on the Letters of Credit for 2005-2006-2007 unpaid special assessment taxes and to inform Mr. McAllister of the city’s decision. Jim seconded. Motion carried 3-0.
MAY COUNCIL MEETING
Kathy moved to move the May 18, 2009 council meeting to May 11, 2009 due to four members of the governing body having 8th grade students graduating that night. Jim seconded. Motion carried 3-0.
DEPARTMENT REPORTS

-Recommends changing official City newspaper to El Dorado Times

-Benton Days April 25th – Tractor Pull is at 10am be there by 9:45am
Joyce -ICI Renewal, council members have a copy of the renewal
Kathy moved to approve the 2009 renewal with Insurance Center Inc. Jim seconded. Motion carried 3-0.
