CITY OF BENTON
MAY 11, 2009
The governing body of the City of Benton, Kansas met in regular session at the usual meeting place in the City at 7:02 p.m. Mayor Ken Gile presided and members of the governing body were present as follows: John Gahagan, Jim Thompson, Kathy Gomez. Dan Carpenter was absent.
APPROVE MINUTES
Jim moved to approve the minutes from the April meeting as presented Kathy seconded. Motion carried 3-0
NEW CONCIL MEMBER
Scott Hartley was sworn in by the mayor.

RECYCLE PROGRAM
Kathy moved to accept the Recycle program with Waste Connections (RecycleBank) effective July 1, 2009. Jim seconded. Motion carried 4-0.
KDOT SHARED-USER AGREEMENT
The Shared-User Agreement between the Kansas Department of Transportation (KDOT) and the City of Benton will allow the City of Benton to operate their communications equipment on the State of Kansas’ 800 MHz digital P25 radio communication system.
Jim moved to approve the Shared-User Agreement between KDOT and the City of Benton. Kathy seconded. Motion carried 4-0.
JOY PLAT
PEC has recommendations on Keith Joy’s Plat. This will be addressed at the June meeting.
DEPARTMENT REPORTS
Charles -update on cases
-request city purchase generator – discussion followed. Dale will get specs to operate city building and community building.
-Probation Officer and additional part time officer
Kathy moved to increase monthly expenditure for part time police officer an additional $500. Jim seconded. Motion carried 4-0.
Joyce -Refunding Bond (Jeff Bridges recommendation)
It is the consensus of the council to instruct Jeff to go ahead with paperwork for sale of the City’s General Obligation Refunding Bonds, Series A, 2009 in the approximate principal amount of $357,000.
Dale -updated council on damages from the storm
-customers who lost their trash cart in storm
Consensus of the council to abide by the contract signed by residents when carts were issued stating customer is responsible for the cart at a cost of $60.00.

Kathy moved to approve the bills as presented. Jim seconded. Motion carried 4-0.
